INDUSTRIAL SCHOOLS.

MAINTENANCE OF INMATES. A rather important ruling has been given by Mr. W. R. McKean, S.M., on the question of maintenance fees for children in industrial schools. Under section 33 of the Industrial Act. 100S, the fee for maintenance of a child was lixed at 8/ per week. In 1909 the *; figure was raided to 10/ per week. An r application was recently made before 1 | Mr. -McKean to raise the'fee from 10/ to "20/ per week. This was opposed on 1 behalf of the defendant by Mr. J. . I Osburne-Lilly. The Crown 'maintained I that section 33 of the Industrial Schools ; 'Act applied to section 92 of the Indus--1 trial Schools Act. Mr. ,T. Osburne-Lilly '■ relied on the amendment of 1909 fixing . maintenance at 10/ per week to support i. hia contention that it was a definite fixed contribution. 1 Air. McKean said that power to ex- - tend orders could be read subject to the . limitations contained in section 33 of the : In '>ir;ai Scho-ois Act, and in his opinion i must so be read. The language of a i statute must be construed as far as posr sibie consistent with every other which did not in express terms modify or - repeal; As there had been no express - repeal of section 33 of the Industrial , Schools Act his Worship said: "I am of opinion that the express limitation con- . tamed in that section prevents one from , increasing the amount of the present order." In respect to an order made for '._ the payment of 21/ per week Mr. Mc- | Kean explained that tho father of the . child instructed the police that he was willing to pay that amount. He re- : marked at the time that he doubted | whether he had power to make such an j order, but under the circumstances would do so for what it was worth.
