Percy Manning, who drove the motor car, stated that he was driving on his rig>ht -side of the road coming round the bend in the road. After rounding the bend bhe horse and cart showed up right in front of him and quite ciose. He immediately put on tlie brakes, which were in good order, and swerved the car to the wrong side of the road to try to avoid an accident. Almost immediately after the ccfl'lisdon occurred the shaft of bhe spring cart smashing through the wind-ehieJd of the car, etruck Mr. Williams, who was in the front seat, on the head. Both vehicles then came to a stop. He was quite sure there was not any light showing in the cart, as if there had feeen he must have seen it. At Hhe time of the accident the car was travelling ait a pace of from 13 to 14 indies per hour, and from what he saiw he judged the cart was going at a "walking pace. There was no warning or calling out from the cart Ibefore the accident. Evidence was given Iby W. L. Gulbb, R. H. Hall, F. J. Va'-entine, R. Steedman, J. Galloway, and Mrs. Heaton as to having pa-ssed the cart previous to tlhe accident, and noticed that it was not showing any lights. The accused was committed for trial a,t the next sitting of the Supreme Court at AiK-Wand.
