MARLEY DIVORCE SUIT.
VERDICT FOB RESPONDENT. PETITION "PREMATURE. -, The hearing of the suit of George Sims Marley, physical culturiet (MrO'U*ry) for the diesolution of marriage with Doris Augusta Marley (Mr. A W. Blair) was concluded in Wellington on Friday before Mr. Justice Saimond. After Mr. O'Leary addressed the Court lie Honor said he did not deeire to hear Mr. Blair for the respondent. Though there was little doubt that the petition was premature, said his Honor, lie did not rely, in dismissing it, solely on those grounds. Insanity was an important matter in determining the relations of the parties in any attempt to prove desertion. The respondent was not mentally sound in February and March, and he was not satisfied, baring regard to her mental condition, that there had been any wilful attempt at desertion. There was no matrimonial home, moreover, at that time, nor did it appear that the petitioner had made any proposals to resume matrimonial relationship. Hie Honor did not suggest anything improper between petitioner and the girl, though habitual companionship had certinly been proved, and this fact, and that it was in defiance of his wife' 3 protests, had probably been sufficient to; cause his wife to refuse to live tvithj him. All though these years the petitioner never seemed to have made any ittempts to resume marital relationship. He did not care to dismiss the petition solely on the ground of prematurity, as deeertion might have been conduced to by petitioner's conduct. Costs on the lowest scale were awarded to the respondent.
