INTEREST ON MORTGAGE.
PLAINTIFF NONSUITED. . TE AWAMUTU, Thursday. An interesting law point was decided by ilr. Young. S.M., to-day. The plaintill in the case in question received a mortgage as part payment for a farm which was subsequently twice sold, the mortgage passing to the defendant. The' claim was for interest in respect to this mortgage. The defence argued there was no priority of contract between the plaintiff and this defendant. The Magistrate held that in the absence of special covenant on the present mortgagor to pay there was nothing in the Land Transfer or Property Law! Acts implying liability to pay Under these Acts plaintiff must sue the! person who mortgaged to him. Plain-' c_£f was tttu-suitcii. i
