MISSING CASE OF KNIVES.
INSURANCE CLAIM CONTESTED. A ease of interest to importers came before Mr. H. W. Bundle, S.M.. to-day, in which Chuickshank, Miller and Co.. Ltd. (Mr. Luxford). sought to recover from the Federal Insurance Co., Ltd. (Mr. Endean), the sum of £49 14/4, insurance on" a case of pocket knives. The case of knives was shipped by the Port Melbourne at New York, and it was stated that Auckland was the first port of call for delivery of cargo, but the goods had never been received by plaintiffs. Mr. Luxford stated £5 ie/o had been paid by the shipping company, for which credit was given. Plaintiff claimed to recover the insurance on the goods, as thp only inference to be drawn was that the case had been lost through theft or pilfering. The defence was that it was a. easp of non-delivery of goods for which the defendant company was not lia,ble under the policy. It was pointed out Hv counsel for defence that goods wore nt times over carried, and reached their proper destination months afterward', also that no proof of pilfering had been produced. Mr. Bundle reserved his decision.
