HINDU HAWKER'S TROUBLES.
RAN INTO BY MOTOR CAR. DAMAGES ALLOWED. Decision was fjiven this mornjng by Mr. H. VV. Uundle, S.M., in a case brought by Kangi Ragha, a Hindu hawker (Mr. J. J. Sullivan), against K. Thompson (Mr. Singer) to recover damages for a collision with :v motor-car nenr Dominion Road. It was alleged that defendant ncgli; 'nth- drove into plaintiff's hawker's tni[>. Mr. Sullivan, in opening, said that on May is defendant's car crashed into plaintiff's cart, and the shafts were broken, the horse thrown down, and plaintiff was hurled in the air. He now claimed £6'B 7/ti special damages and £50 general damages. Evidence was given by George Stewart, motorman, who witnessed the accident, that defendant ran into the back of plaintiff's cart. He did not hear the horn blown. He" considered there was room for defendant to have avoided the collision. The defence was a denial of responsibility for the collision. Mr. Bundle said he was satisfied that defendant was not driving carefully when the accident occurred. His Worship said lie preferred to believe the evidence of the tram employee. Mr Stewart, who saw the occurrence. Judgment was therefore entered for the plaintiff for £33 7/0, with costs.
