W. roynton, S.M., charged that be had failed to proI vide his wife with adequate maintenance. Mr. R. A. Singer, who appeared for the ■wife, stated that Burgess had been arrested on a complaint by the wife that he was about to leave the Dominion. She had received information from the South that he was about to go to Christchureii and join another woman with whom he intended leaving the country. Counsel added that he was not in a position to produce the evid«nee of witnesses from the South, and would require an adjournment. Mr. Hosking, counsel for objected to the adjournment, aa the charge was merely one of failure to maintain, and he could prove that defendant had made full provision for the maintenance of his wife, Trhom he had ect up in a boardrnghouse. Defendant had no intention at all of leaving >iew Zealand, and it was infamous that a man could not go for a few days' holiday without beins: submitted to the indignity of arrest. The action suggested malice on the wife's part. Mr. Sinjrer replied that he was preparing another information charging defendant with being about to leave New Zealand without having made adequate provision for his wife. He had information on the subject, and would immedh atsly have defendant charged with that offence, which would necessitate as adjournment till opportunity w»» allowed for the production of Southern witnesses His Worship remarked that in the circumstances aD adjournment would be 1 best, and the cas-e was adjourned for eight days, bail being allowed in one surety of £75.
