A WIN FOR A LAND AGENT.
SEQUEL TO A FARM SALE. The story of a cheque for £7 5/, paid by a Kurd agent to a firm of solicitors. who retained it pending the settlement j of .their own account hy the payee, was told in the Magistrate's Court yesterday, .Mr. I. W. I'oynton, S.M.. .pros hi in-:. Th? plaintiff, William James Morris I Mr. P.. Inderl, Birkdale. sued Korbes Eadie (Mr. .1- K. W. Dickson), land agent, Auckland, for £7 .">/, being half c.oinmi<ssion on the sale of a farm property. It appeared that Eadie -had passed on t.he cheque to the solicitors, a tirm not engage! in the Court case. Defendant said he was instructed by .tlie plaindT to get certain work done in connection with ti.e land deal. This necessitated some legal work, and the 'plaintiff had suggested that the cheque for the commission should he sent- to the lawyers. The plaintiff, however, denied that he had given any such instruction. and refuse! to endorse the cheque to enable the solicitors to deduct £3 3/ to meet their ai-count, all liability for which he repudiated. The magistrate sad the defendant's stony was the more probable of the two, and he gave judgment in favour of Eadie. with i!" 247 costs.
