A COMMISSION DISPUTE
PUBLIC TKUSTEE'S AGENT.
The reserved judgment of Mr. Justice Sims in the case J. 8. Bond v. the Public Trustee was delivered at Hamilton to-day. The plaintiff acted as agent for the Public Trustee at Hamilton for the period 1898 to 1919, and the dispute related to his remuneration, which he alleged was to be half of the commission charged by the Public Trust Office on the capital and income of the assets of estates introduced by him at the commencement and one per cent of the interest collected on office investments. It -wae admitted by defendant that plaintiff was entitled to remuneration at the specific rates on all assets realised oti the income collected, during his engagement, but it was denied that he was entitled to any remuneration since the termination of his engagement. Plaintiff further alleged that he introduced estates now being administered, comprising hundreds of thousands of'acres, and that he also, introduced 180 persons still living who made wills appointing defendant as executor and trustee thereof. His Honor, alter reviewing all the evidence, said that plaintiff was entitled to his share on commissions on all realisations and collections up to and including July 31,'101D. The defendant had had a statement of these made. up end paid intq the Court the amount which he admitted plaintiff was entitled to recover. Plaintiff had not had an opportunity of checking this statement, and was entitled to have an account taken before the registrar to assess the amount that was due up to the date mentioned. Further consideration of the action was adjourned wtih the usual leave to apply. All question 1 of costs was reserved.
