An undefended action in divorce was heard this morning before bis Honor Mr. Justice Cooper and a jury of twelve. Henry James Durrant (Mr., Singer), a returned soldier, petitioned for a dissolution of his marriage with Marguerite Durrani, and claimed £300 dynages from the. co-respondent, one William David Merrick. The marriage had occurred fa London on October 8, 1918, when Durrant was a member of -tire N.Z.E.F., and he returned to Auckland last July, bringing his wife ■with him. She was not content living in . the house of Lis parents, and in October i last she asked for separation and maintenance, but the magistrate would not grant separation, though he made a maintenance order. His wife had left him before this, and had made a-written ad- , mission in February last that she had I been living with Merrick as his wife. j The jury, after a brief retirement, '• _ecided that adultery had been comtaitted. - and assessed the damages at £25. The' I decree nisi is held up by a documentary ' Inconsistency.
