CLAIM FOR POSSESSION.
• • . ' A case was heard before Mr F X Hunt, SJtf., at the Magistrate's Court yesterday afternoon, in which J H Hannan sought to recover from John Pates (Mr. J. J. Sullivan) possession of i a tenement and arrears of rent Mr. Sullivan said they had paid into Court all the rent, defendant admitted! to be due. Mr. Hannan really wanted i possession of the house. Mr. Hannan said he wanted to <r e t possession in order to have the place thoroughly renovated. He let the house on a weekly tenancy. He complained that doors were missing from the washhouse and from the entry underneath the house. Mr. Hannan offered to par for a motor car to take the magistrij* to view the house. He was prepared to accept the rent paid into Court. Notice to quit was served on October 20. Mr. Hunt said the notice was not a legal one to quit. Mr. Hannan said people could not find a house, and it was hard to turn them on to the street. Mr. Sullivan said the defendant claimed exemption under the War Regulations Act. As long as rent was paid notice to quit was of no value. Defendant was a hard-working man with eight children. Mr. Hunt said Mr. Hannai) had got his rent. He should give defendant one week's proper legal notice to quit. Judgment was therefore given for the plaintiff for the amount paid into Court.
