DAMAGES CLAIMED FOR ACCIDENT. i A case came before Mr. J. W. Poyn-I ton, S.M., at the Magistrate's Court to-{ : day in which a claim was made for £200 las damages arising out of a collision be- ! tween a motor car and taxi cab at ; Devonport. The plaintiff was William . James Sparkes, taxi proprietor (Mr. E. ! Indcr), and the defendant William Batts, I clerk of Ponsonby (-Mr. J. B. Johnstone), i The plaintiff alleged that the damages' i were caused by the negligent and unskil- ; ful driving of defendant, which resulted lin plaintiff being forced to run his car' I into the kerb, whereby it sustained ; damages as follows: —Cost of repairs! ' £S7 10/, and loss of use of car for 26. weeks £83 4/. General damages to the extent of £50 were also claimed, making a total of £230. Plaintiff abandoned | the £30 in order to bring the case in . the Lower Court. | Evidence was given by the firm as to ! the repairs that had been done to the ! plaintiff's car. Witness was crossexamined at some length as to whether jor not all the repairs executed were ' absolutely required as the result of the ! accident.
