POLICE COURT.

(Before Mr. F. V. Frazer, SM.) DRUNKENNESS. Albert Madigan (27), charged with being disorderly while drunk in Inkerman Street yesterday evening, explained his behaviour, of yelling out in the street and refusing to go home when advised by eaying it was no good going home as his tea was not ready. He wae fined 10/ and 10/ expenses. THE GOODWILL SEASON. . Thomas MeGarry (42) admitted that on December 26 he assaulted Andrew J Lewis. It was stated that Lewis, an elderly man of 59 years, wag living at the Salvation Army Home with his son. Between 8 p.m. and 9 p.m. on Boxing JVight, McGarry, eomewhat under the influence of liquor, called to ccc the son and was told he was not in. McGarry wae not satisfied, and Lewis invited him to come in and see for himself that the son wae not there. McGarry did so and when he could not find Lewis, jun. the old man told him if he was now satisfied he had better get out. McGarry took offence at the remark and walked over to the old man and hit him, blacking both hia eyee and breaking his nose.

Mr. A. Moody, for accused, stated tiimt Lewis, sen., was a rather cantankerous old man, and that hia offensive manner provoked McGarry, who was pretty well drunk, to retaliate. McGarry w«e a scow-hand, a mate of Lewie, jun., and his .boat wa3 going out of port to-day. McGarry wae fined £5 anu ordered to pay 21/ medical expenses, half the nne to go to the complainant. A month was allowed in which to pay.
