Tlie Full Court this afternoon heard argument on an o-iginating summons in tbe case of the Public Trustee in the estate of Elizabeth Kainham. deceased. v. John Henry Heidemann. Tlie testatrix by her will left certain freehold propert}' to the defendant Heidemann. who is an alien enemy and the questions for tiie Court's determination are: — (1) Whether the defendant is entitled to acquire and hold for bis own benefit freehold property in the estate: or (2) •whether such freehold property vests in the Crown, by v.rtue of the "fact that the defendant is an alien enemy. Mr. iElay appears for the Public Trustee. Tlie Solicitor-General, Mr. J. \V. Salicond. XX.. who appeared for the Crown, asked the Court to make a declaration That the land was held in trust for the Crown. .Mr. R. H. We j'u. for the defendant, stated that his client only desired that the property should be passed on to the daughter of the testatrix if the Cruwn CO-nld see its way to do so. The, decision was reserved.
