A DRAINAGE CLAIM.
— ■ ■■ » . ll— DISPUTE BETWEEN FARMERS. . A case was beard before Mr. Justice Cooper, in the civil division of the Supreme Court, yesterday, in which one Taupaki fanner sued another for £10 damages alleged to have been caused to land by the cutting of a drain. The plaintiff was Charles Crisp (Dr. H. DBamford), and the defendant George Snowsill (Mr. R. L. Ziman). Plaintiff alleged that defendant cut a drain -through part of Ms land causing water to overflow on to and injure ; plaintiff's property, and that defendant had also threatened to extend the drain in question, and to cut others to connect with it. He asked therefore, in addition to - £10 as damages, that defendant be restrained from cutting any further drains likely to lead water on to his land, and that he be required to close the dram already cut. The statement of defence contended that the plaintiff was not the owner of the land as stated, but only an occupier.. Plaintiff's allegations generally were also denied, and it was submitted that "plaintiff was not entitled to recover the money claimed or to any injunction or relief. "> Later hr the day Mr. Ziman put in an amended statement, which plaintiff's counsel said he would require time to considers. The case was accordingly adjourned sine die, counsel's fee and witnesses' costs being- allowed plaintiff.
