The charges against the , latter were in regard to compulsory phy- ( sieal exercises, which it was alleged he j carried out in a negligent manner, and *( hot according to orders. i( Warder John Bryan, drill instructor, \ continuing his evidence, stated in answer j to Mr. Hall Skelton, that he had not i " got Cates set," and he had never shaken s his fist in Cates' face in a threatening manner. He had no personal animosity j against him, and so far as lie knew, ( Catea did all his duties, except drill, ( satisfactorily. ~ Peter McGrath, and Arthur William Kitteridge, probationary warders, gave , evidence as to Gates' behaviour at pby-1 j sical drill, and arguments that tooJ; | j place between Cates and the instructor. ■ They stated that Cates did not do his , drill as well as the rest of the squad, and that Bryan generally gave his instruction to the squad distinctly and well, with few mistakes. Thie concluded the evidence for the Prisons Department. Cates, called by Mr. Hall Skelton, stated that he entered the prison service in October 1913, after nine years' ser- ( vice in the Royal New Zealand Artillery.
