Mr E. C. Cutten, S.M., was occupied the whole of yesterday afternoon at the Magistrate's Court, with a case in which, as usual, the stories of plaintiff and defendant were diametrically opposed. Henry Daniel Lampe (represented by Mr A. G. Pilkington) sought to recover from Mrs Ellen Kirk (Mr Black) £4 "/, which sum had been paid for furniture on her behalf. The defendant entered a counterclaim for £11 18/, for 58 meals at 1/ each, and nine weeks' board at £1 per week. Plaintiff said he paid for the goods as he thought defendant was going to marry him when she got her divorce. When they fell out, he wanted either his goods returned or the money refunded. He admitted having odd meals at Mrs Kirk's house, but denied having lived there. Mrs Kirk stated that when she wanted to pay for the goods, plaintiff refused to take the monpy, and he gave her the receipt. He pestered her to marry him, but she told him she was not free to do so. After hearing further evidence, Mr Cutten gave judgment for the plaintiff on the connter-claim, and also for the amount claimed, with costs.
