HARD EARO-TR IN FRAMES. 1 Edward Cox (301. put forward the * plea thai, he was drunk as an ex-use 1 for stealing ten small photo frames 1 from the from of .la-o-h Bert-eiF. shop " in Queen Street last nigh.. A by passer 1 noticed Cox take away Lhe frames and ' informed Constable ih-aly. who wen; in ' search of the man. and found him in a 1 bar. having a drink, and with the photo ! I rallies under his arm. lie had cvi- ' dently been drinking, but was not drunk. 1 -.cnior-'Sergeant Rutledge said that ' a«_»<.- had been twice previously .011----1 victe.l of theft and __*■_ for vagrancy. 1 Accused was .eiMonced -.. three months' hard labour. . SIX SHILLINGS AND A SHOUT. ' William Godfrey Nolan i-ttli and 1 .10-cph 1. Tobin i_l» 1 were charged that ' on April _nl they stole four cases ot 1 fruit, value 15/4. the property ot Kate ' Nicholas. Nolan pleaded "guilty." 1 Detective Si-ott said that on the date * in question. Mrs. Nicholas, who had a ' fruit shop in Onehunga. had bought the ' four cases of fruit at the market, when " she wa- approached by Nolan who asked * if she wanted the fruit carted to One hunaa. and indicated Tohiu as a carter. " They got the receipt and gave it In the ' auctioneer, getting the fruit, which they ] took away and sold to a hawker, loom .was in company with Nolan when the . fruit was stolen. , Evidence to this effect was given, a , fruit hawker i-tating that Nolan sold the fruit to him for six dulling., with a "shout" thrown in. at the same time , stating that tiie fruit wa- "all right." . meaning it had ti d been stolen. 1 1 Both men were convicted, and sentence! to a month's hard labour each, > the Ben h remarking thai Nolan had a - particularly l>ad record, and that hif mate appeared to be following in his r footstep.. Mr. .1. K. I.undon appeared later, and 1 put in a plea for clefiiency for Tobin. 1 on the ground that he had been drawn '■unthinkingly int.. the transaction, had la wife and had not a liad record like I Nolan. Counsel suggested that accused t should have an option of a fine. The Bench decided to give Tobin that . chance by fixing a line of !__. and IS/ - costs, with the default of a month's ' hard labour.
