I (By Telegraph.— Tress Association.j WELLINGTON, Wednesday. 'A point arising out of a perjury case •was decided by the Court of Appeal to- , day. The facte were tbat Samuel , Francis Aitken was found guilty of falsely swearing he was married when he applied for a publican's license. The Chief Justice reserved for appeal the Couxr/s decision on the question ■whether tie magistrate, who ieard. the application, under section 85 of the Licensing Act, acted in a judicial capacity, sentence being deferred in the interim. The Court held that the magistrate had not acted in a judicial capacity, and quashed tbe conviction.
