EXCLUDED FROM A UNION.
THE LAW ON TEE SUBJECT,
(By Telegraph.—Own Correspondent.)
WELLINGTON, this day. Dγ McArthur gave judgment at Wellington yesterday for the secretary of the Seamen's Union in an action by Julius Hanson to recover £19 as damages for relusing to readmit him after he had lioen for nine years a member of the Wharf Labourers' Union. His Worship arter the points of law raised, said it seemed conclusive that any Court could not entertain any legal proceedings instituted with the object of enforcing or recovering damages for non-admission of a new member into a trades union. That might be contrary to the spirit of democracy of the present day, but it appeared to him to be the plain reading of and the conclusion to be drawn from "the Act. The gist of the argument of counsel for the plaintiff was that plaintiff was written off the books, and that therefore all he was liable for in order to rejoin the union was at the utrooat to pay one year's arrears in order to rejoin as a hew member. "This," said the magistrate, "I would be willing to admit, had the society or union remained registered, but this was not so. I hold there is no power for this Court to enforce or uphold the claim of the plaintiff, therefore judgment must be given for defendants."
