CLAIM FOR COMMISSION.
Farther evidence was given to-day at tie Supreme Court, before hi 3 Honor Mr. Justice Edwards, in the case Curry *nd Co., of Auckland, timber brokers, >pinst Easson and Co., of Wellington, timber merchants, claim for £362 comSKsion on the sale of timber to certain Australian firms. The orders Vere partly filled, and commission wa3 paid on the amounts which Easson and Go. had received from their customers. Tie defence was that Curry and Co. were only to be paid on the shipments for which the defendants had received payment. His Honor pointed out that fflless the defendants could show that tiere had been a special contract with Qury and Co., t_ie latter we-e clearly, according to usage, entitled to the comsusskra on the whole amount of the order. In answer to his Honor, the deKMant, in the course of his evidence, said he was satisfied that the firms he was dealing with in Australia were solvent, that the contracts were valid, Md that the firm of Easson and Co. had faithfully observed the terms of the agreements. His Honor said if those «sts were admitted, it was not fair 'iat Curry and Co. should be deprived ot their commission simply because the defendants did not choose to enforce the Matracts.
