VERDICT AGAINST MRS. O'SHAUGHNESSY.
MOTION FOR LEAVE TO APPEAL. In connection with the application made by Mr. Singer for leave to appeal against' the verdict of the jury in the charge against Martha Jane O'Shasughnessv, on the ground of misdirection, counsel again referred to the matter this morning. His Honor remarked, with some emphasis, that the second paragraph in the statement of submissions did not represent what he bad put to the jury. Mr. Singer: Your Honor said, "You may take it from mc, gentlemen His Honor: I know what I- said, but that paragraph absolutely misrepresents what I said. I don't say you intentionally misrepresented it. His Honor added that he had not yet decided what course he would take in regard to the application, but he certainly intended to sentence the prisoner \ before leaving Auckland. Mr. Singer submitted two further points as bearing on the misdirection (1) That his Honor misdirected the jury in directing them that it was open to
them to find the.accused guilty of man- i slaughter. (2) That there was no] evidence the accused considered herself . so skilful that she could perform the ] suggested illegal operation without i danger. I His Honor: "They are only in support of the argument you have raised." I ALLEGED ILLEGAL OPERATION. ! The charge against Mrs. Liilan Lang that in October last she performed an illegal operation on a single young woman 52 rears of age, was heard be- i fore Mr. X C. Cutten, S.M., in the Police i Court yesterday. After evidence had i been given by the girl as to her treat-1 ment by accused, and to her subsequently ' going to the Auckland b.-3pital, and by , other witnesses, including a young man • who made preliminary inquiries, and stated that he paid Mrs. Lang £25, the accused entered a plea of "Not guilty," and was committed to the Supreme Court for trial.
