S.M. COURT.
(Before Mr C. C. Kettle, S.M.) UNDEFENDED CASES. Judgment wa_ given by default yesterday afternoon iv the following cases:—Carr, Pountney nn_ Co. v. W. Splttlehouse, claim £17 8/4; Walter Punch v. Schnledeman Bros., claim 10/. DEFENDED CASES. Claim for Bricks. —J. J. Holland v. Henry Lewis. This was a claim to recover £30 15/, alleged to be due for 49,200 bricks. Ther. was a counter claim of £14 8/4 on account of alleged short supplies having necessitated the purchase of new bricks. Mr Prendergast appeared for plalntlf., and Mr Lnndon for the defence. James Job Holland deposed to agreeing to sell defendant 50,000 secondhand bricks at 12/_ per thousand. There was no stipulation as to the quality of the bricks. They were to be whole bricks, but of course a percentage was broken in cartage. Defendant told him there were 8000 bricks short, but that was because he only counted whole bricks. Defendant engaged his own carter. Evidence was given by other witnesses to show that 600 bricks was a load for each dray, and that only whole bricks were loaded.
