CITY COUNCIL V. TRAMWAY COMPANY.
SUPREME COURT PROCEEDINGS. (Continued from page 5.) To Mr. Cotter: The Council did not consider that by giving the Company notice to provide a certain number of cars by a certain date that they were relieving the Company of its obligation to provide sufficient cars to meet the requirements of the public. There was nothing in the amended time-table to run as many cars as they pleased in addition to those specified.
Arthur P. Friend, an insurance, adjuster, residing j n Parnell, said he had been travelling constantly on the tram cars for the past twelve months. There was frequently insufficient accommodation in the cars from the terminus for intending passengers. Owing to the tremendous crush between 5 and 6. he adopted the expedient of staying in town later, and got into the habit of doing so. The conditions of the service was very much better.
Mr Bell: I presume you do not fight with women to get on the cars?—l've had to battle pretty hard to get on. Mr Cotter: Is it"not a fact that you have to disregard your feelings? His Honor: You mean to suggest, Mr Cotter, that the gentleman's gallantry is impaired by the position of the cars? (Laughter.)
Henry Charles Holden Walker, a warehouse manager, residing in Bemuera, said he had been using the tram cars ever since they started; said that between the hours of 5 and 6 p.m. he could very seldom get accommodation on the cars, except by waiting for the third or fourth cars leaving the city terminus. He had frequently walked to the first stoppingplace, and paid au extra penny to come back in the car in order to secure a. seat. Very often the cars were filled with passengers for the penny section. (Proceeding.)
