ACQUITTED OF MANSLAUGHTER.

At the Ararat (Vie.) Criminal Sessions, Edward Melvin Smith, a youth, was charged with having, at Jeparit, killed John Joseph Tilley. Deceased and the prisoner played billiards at the Hindmarsh Hotel, and some betting was indulged in. A disagreement arose outside, and the prisoner struck Tilley on the back. He fell, and died in less than half an hour. The depositions of a doctor showed that death was due to suffocation, and that if he had been allowed to lie down he probably would not have died; but his friends, with the best of intentions, sat him up, and the flow of blood caused suffocation. Mr. Justice a'Beckett said that if manslaughter had been committed it was in a very minor form. The jury returned a verdict of "not guilty," and the prisoner was discharged.
