APPEAL CXHEtT DECISION.

WELLINGTON, this day.

The Court of Appeal gave its decision to-day in the case of Rex v. Peddle, who was tried recently at Napier for assaulting the sheriff. The Court, without calling on the defence, gave judgment that Cutten's appointment as sheriff, was perfectly valid; that if he exceeded his power—as to which Court expressed no opinion—PeddJe's remedy "was by action, and the assault not justified; and, lastly, that if the l«id was not sufficiently identified that omission was cured by the prisoner's admission in giving evidence. The con-fictio-g was therefore affirmed.
