YESTERDAY. \
(Before Mr C. C. Kettle, SOI.) Alleged Obstruction.— James Blakie ! and Robert Blakie. who were represents i ed by Mr Haekett. were chained that on I June 6th they wilfully obstructed Queen- I street. Sergeant McPhee said that on i June 6th. about half-past twelve, he no- : ticed a crowd of over 30 people standing opposite Coombes , Arcade. The two fendant3 were amongst the crowd which was taking up about half the footpath. I After about five minutes from the time ' witness and Constable O'Connor arrived I on the scene, the two defendant? moved ' into the Arcade, after which the crowd dwindled away. Cross-examined, witness ! said the defendants were not on the foot- j path. In witness' opinion the defend- i ants were responsible for the presence of the crowd. Constable O'Connor also ! gave evidence. Robert Blakie said he j was waiting for a tram on June 6th with his son. when Mr Churton came up and j spoke to him. He denied absolutely ! that he was in any way responsible for i the crowd that had collected in the j vicinity. James Blakie gave similar cvi- j dence. John Churton gave evidence cor- ■ roboratmg the statements of the previ- i ous witnesses, stating that he was not : concerned in any way with the crowd I that had gathered, nor was he transact- ' ing any betting business. His Worship : i said he had considered the appeal from , Mr Dyers decision, which had been rip- ! eided by Mr Justice Edwards. The farts of the present ftvs-e were absolufplv different from the facts which were ad- - mitted and proved in that rasp. He i s doubted whether, apart from the cvi- i dence of the defendants, he would be i justified in drawing an inference hostile : i to them. Under the cirenmstances the ' I case differed materially from the appeal i decided before Mr Justice Edwards. A i similar information with respect in Mr i Churton would be dismissed, as wpII as | c those against the other two defendants. ; i "-— ' ' i 1
