CONVICTION QUASHED AFTER

SENTENCE SERVED,

WELLINGTON, this day.

In the Appeal Court this morning the case came on for argument of Rex v. Searley. The defendant had been convicted at Wanganui, under Section 412 of the Criminal Code Act, 1893, on the charge of alleging that he was a qualified medical practitioner. The Chief Justice and Mr. Justice Chapman now thought that the conviction should be quashed, and no new trial ordered. Mr Justice Edwards and Mr Justice Cooper agreed that the conviction could not stand, but expressed opinion that a new trial should be ordered. The result is that the conviction is quashed and no new trial is ordered. Searley was unable to find bail, and served his sentence of three months (in gaol), and he has long since been discharged.
