CHARGE OF THEFT.

WAIHI, this day.
f In the Police Court this morning be-fo-re Messrs Moore and Holmes, Justices, Thos. Ward and W. Griißn, on remand, were charged with theft from a dwelling at Waihi on April 9th of articles valued at 14/5 and cash amounting to £9 17/, the property of W. Mooie and R. Mitchell. Sergt. Meiunnon prosecuted, a-nd Mr. Jackson defended. The evidence showed that accused lived with complainants in a shanty, and that the money Avas taken from a mattress where it was placed by Mitchell, and from Moore's clothing. Accusec\ disappeared. They were nest seen at Katikati, then at Te Aroha, and at Auckland. One of the accused was arrested in the King Country, and the other in Auckland. Cross-examined by Mr Jackson, Mitchell admitted having been convicted of sly-grog selling in the Kmg Country. Mr. Jackson,, in addreasing the Court, said the case for tne prosecution was only surmised s\nd nothing proved. (Proceeding^
