Between JOHN McEFFER SHERA, Petiouer, And FRANK LA WRY, of Auckland, Settler; JOHN KING, of the same place, Registrar; and JOSEPH GILMORE, Returning Officer for the District of Parnell, Resoondents. TO HIS HONOUR THE CHIEF JUSTICE of the Supreme Court of New Zealand. THE PETITION of JOHN McEFFER SHERA, of Remuera, Land Agent, whose name is subscribed, SHOWETH 1. Your Petitioner John McEffer Shera Is a person who was a Candidate at the above Election. 2. Your Petitioner states that the Election was hokleii on the 25th day of November, 1902, when Frank Lawry and John - McEffer Shera (your petitioner) were Canu didates, and the Returning Officer, by no- ■•- tice, published on the 28th day of November. 1902. has returned the said Frank - Lawry as beiDg duly elected by a ma-jority ~ of One Hundred and Twenty four votes. y 3. Your Petitioner further states that n - large number of names of persons were wrongfully and without motive removed by the Registrar of Electors from the Roll purporting to be the Roll of the above Electoral District of Parnell.' That a large number of names, amount- , Ing to one hundred and seventy five or f thereabouts of persons were wrongfully res moved by the said Registrar of Electors , from the said Roll after the Eleventh day 3 of November, 1002, being the day of the a issue of the writ for the election of a mem- - ber for the said district, and before the 5 abovementioned twenty fifth day of Novemr ber, 1902, and before tne completion of the said election. 5. That by notice dated the Twenty first "* day of November, 1902, and publicly notified by publication in the "Evening- Star" ' Newspaper and "The New Zealand Herald" Newspaper, the said Registrar of Electors gave notice that a large number of persons whose registration numbers were stated in the said notice had been struck off the said roll, and that such persons .would not be allowed to vote at the said Election, and that the Returning Officer had been instructed not to permit such persons to - vote. 0. That the Registrar wrongfully reject- • ed a number of claims for enrolment on the said roll of the said district. 7. That there was no valkl Electoral Roll for the said district prepared and signed 3 by the Registrar of Electors as required by "The Electoral Act. 1902." in existence at j the date of the abovementioned election. 8. That the Roll used at the aforesaid 3 Election was not the Electoral Roll for the said Electoral District. » 9. That the Returning Officer and the several Deputy Returning Officers who • conducted the said Election were not supplied with certified copies of the Electoral i Roll for the purpose of conducting the saKf Election. 10. That the Returning Officer did not arrange for or hold any scrutiny of the - Rolls" after tb> close of the Poll for the fc aforesaid Election and before declaring the result of the Poll. s Wherefore your Petitioner prays that it may be determined that the said Frank " Lswry was not duly elected or returned, and that the abovementioned Election was * void.
