Motion for Discharge.—Alexander Gorrie, a bankrupt, applied for a discharge. Mr. TV Cotter opposed the application on behalf of a creditor. His Honor refused to grant the order for discharge. CIVIL SITTINGS. Frank Smart v. Arthur Somerville Dixon.—This was an action for the specific performance of a contract to sell a lease in perpetuity of a section of 300 acres in the Tokatoka swamp for £859. The defence was that before the transfer was executed, plaintiff arranged to sell the place to J. W. L. Edson for £1150, the contention being that such sale was contrary to the Lands Act, and that, therefore plaintiff was not entitled to get a transfer. Mr. Hugh Campbell appeared for plaintiff, and Mr. W. J. Napier, M.H.R., for the defence. The evidence lasted until the adjournment, and at 2 o'clock counsel addressed the court. ... _...,... ..
