ACTION TO RECOVER RENT.

Mr. R. S. Bush, S.M., had an interesting point laid before him at the sitting of the Warden's Court, Te Aroha, on Monday. Eight summonses had been issued by the Receiver of Gold Revenues against the Rev. Joseph Campbell for arrears of rent on various mining claims.. The total amount claimed was £538. Mr. Gilchrist, who appeared for the defence, said that in all these cases there had been an actual abandonment of the claims before the rents were incurred. Mr, Gilchrist quoted a Supreme Court decision given in Dunedin, which ruled that under the Mining Act of 1891 a licensee was only liable for rent during the time he actually occupied the land comprised in his license. The Warden adjourned the case for two months in order that Mr. Campbell's evidence might be taken upon the matter.
