Alex. A. Phillips v. Samuel Marks. Claim, £0, general damages on account of plaintiff having to pay the Collector of Customs double duty upon a gold chain sold to him by defendant; upon which -duty had nut been paid. Mr Iteed appeared for the plaintiff, and Mr Baume for the defendant. The defence was that defendant had sold the chain believing that the duty had been paid, and had further offered, without prejudice, to return the money paid and all charges incurred by the plaintiff if the chain were restored.' His Worship reserved judgment. Waltemata Sawmill Company v. Charles Grant.—Claim, £141 7/5, balance of account between plaintiffs and defendant. Mr Cooper appeared for the plaintiffs, and Mr Beod for defendant. The case was heard lust Court day, when Mr Iteed raised the question of the jurisdiction of the Court to trythe case, the credits and debits exceeding the jurisdiction. Mr Brabant held that the Court had no jurisdiction, and the case was struck out.
