CLAIM FOR COMMISSION.
At the S.M. Court this day judgment was given in a case in which AndreAV McLeod sued T. G. Tanton for £25 13/6, commission alleged to be due to plaintiff for obtaining as tenants in defendant's Queen-st. properties tAvo men, Messrs Bradley and Crick, no arrangement being made with plaintiff as°to the amount of commission to be charged. There Avas a counter claim T. G. Tanton v. Andrew McLeod for £50 damages, Tanton alleging that McLeod did not exercise due and proper care to see that the persons mentioned were reliable persons; that in consequence of this Tanton had been unable to obtain any rent. Bradley, a commission agent, had been committed for trial, but died in the Hospital, and Crick, an electrician, had left the colony. Air M. McGregor appeared for plaintiff, and Air Theo. Cooper (instructed by Mr Coleman) for defendant.
Evidence Avas heard after Aye Avent to press yesterday, and at 2.30 this afternoon His Worship gave lengthy judgment, and said the plaintiff had not made out his case for .commission. With regard to the counter claim, His Worship said he thought both parties were to blame. The defendant had not made out his claim fojr- damages. Judgment was g-iA-en for the defendant on the claim, and for plantiff on the counter claim. No costs were alloAA'ed on either side.
