ACTION FOR DAMAGES.
Mr H. W. Brabant, S.M., was en*; gaged at the Magistrate's Court today in hearing a claim for damages arising out of the recent flooding of a portion of Freeman's Bay through rain waters being dammed back in the sewer in course of construction. Rachel Britton, widow, ol Willow-st., Freeman's Bay, sued Daniel Fallon and son for £60, damages alleged to have been caused to plaintiff's premises through flooding. The plaintiff contended that the defendants so negligently and unskilfully carried on the work in connection wdth the sewer through the Freeman's Bay reclamation as to cause the water to be obstructed and so banking it up against the plaintiff's premises, whereby dam* age was caused. Mr McGregor appeared for the plaintiff and Mr Hugh Campbell (instructed by Hesketh and Richmond) for the defendants. A considerable number of witnesses were called, and the case was proceeding when we went to press. Mr Anderson, City Engineer, and Mr Ashley Hunter, C. E., the engineers who are overlooking the construction of the sewer on behalf of the local authorities were present during the proceedings.
