Jones denies that he was not duly qualified to make application and sit for examination. He denies that Captain. Allman falsely represented that the Minister of the Marine Department authorised and directed that he should be-permitted to'sit, or that rthe Minister expressly authorised and.--directed that defendant be allowed to present himself for; examination* He denies that he, produce^ any papers wi%h the object of fraudulently obtaining from the Minister a report that he had passed; or* that he was guilty of any fraudulent or collusive act, but says*he was duly examined by the proper and responsible officers and that he passed. He further con-tends-.that the Governor possessed no authoritty or power to issue an Order-in-Council cancelling''his certificate.
