TOTE BETTING.
At Wellington yesterday, Elias Gaudin was fined. £15 and costs for tote betting. An indemnity certificate was asked for on behalf of the police officers who betted with the man in order to obtain evidence, but Mr Kenny, S.M., said the indemnity clause in the Act only referred tfc of; fences connected with gaming-houses, and declined to give the certificate. With regard to a suggestion by Mr Wilford, counsel for the defence, that he should give some expression of opinion on the Act itself, Mr Kenny considered that it would be improper and injudicious to do so. Mr Wilford stated that he had drawn informations against Detective Broberg and Proba-tionary-constables Kidd and Macafthy for conspiracy to commit a crime, and asked the Court to order their arrest. Mr Kenny refused, as they were only subordinates, but said anyone could lay an information. Mr Wilford said this would be done.
