THE MIDLAND RAILWAY CASE.

Hearing of the Midland Railway case was begun to-day before the Chief Justice and Judge Edwards. Sir R. iStout and Mr Theo. Cooper and Mr Findlay appear for the Receiver, and Messrs Coates and Quick for the debenture-holders, and Messrs Bell and Gully for the Government. There are two motions before the Court. One is for a .summons directing the Crown to show cause why absolute sale of the railway should not take place, under which the Receiver should obtain possession of the railway and sell it if he thinks fit, and the other is a summons by the Crown to the Receiver to show cause why an order appointing him should not be rescinded or varied, inasmuch as that order directs absolute sale of the railway, which the Crown alleges the Court has no power tp order. It is understood the case, which is expected to last several days, will go to the Privy Council, whatever may be the result of the present argument. ■ WELLINGTON, December 13. The hearing of the Midland Railway case was briefer than expected. Mr Gully followed Mr Bell for the Crown, arguing- that what, the debentureholders wanted was to get the constructed portion of the line, which was of value, and be discharged from all obligations under the contract. Sir R. Stout replied. He asked the Courtin deciding the case to settle the question first whether the debenture holders were en titled to possession of the constructed part of the railway, and secondly whether they were entitled to have an order for the sale of either of the two constructed portions of the line. Judgment was reserved.
