"mHE TRAMWAYS ACT, 1894." X BOROUGH OF PARNELL.-Notice is hereby given that it is the intention of the Body Corporate called tho Mayor. Councill6iv, and Burgesses of the Borough of Parnell injcorporated under the provisions of "The Municipal Corporations Act. 1886," and its amendments (hereinafter called the Local Authority), to apply to His Excellency the Governor in. Council for an authorising order under the provisions of "The Tramways Act. 1804." authorising the construction o£ tramways through or over or along the streets or roads of and in the said Borough of Parnell with electrical traction by means of theoverhead system as the motive power, and. further, that in tuti event of such authorising order being granted, it is tho intention of the said local authority on the granting of the same to delegate the authority conferred by such order to* the persons hereinafter named in terms of the power vested in it by Section 10 of the said Act. (A) The description of the proposed work; (B) the place where the plans and'cross sections are deposited for public inspection : (C) tbe names of tbe persona to whom the authority contained in the said order is to be delegated; and (D) a general description of the terms and conditions subject to which such delegation is to be mado as follows:—(A) The description of the proposed works being—The construction of a line of tramway from the boundary between the City of Auckland and the Borough of Parnell, passing along Alpha-street and Manukau Hoart to the boundary between the Borough 3of Parnell and Newmarket The guage of tho tramway is to be 4ft. BJin. Double lines to be permitted throughout." Electrical traction to boby nieaas of overhead system, in which the current is supplied to the car motors by a strong wire called the "trolley wire." suspended about 20 or 21 feet above the surface of tho street. All poles supporting said wire to be in the line of the kerbs. The trolley wire being suspended from bracket arms, or from span wires across tho street, is supplied with electric current from tbe generating station, by means of underground feeder cables, Tho poles and span wires or poles and brackets to be crsced all along the route at intervals of about 40 yards. The return current to be by metallio conductor cablos laid- for the purpose. The whole to be in accordance with the regulations of the Board of Control, constituted in terms of "Tho Tramway Act, 189 V and subject iilso to the rules of the Hoard of Trade in London in reference to electric traction being observed in such construction. (B) The plans and cross-sections showing the nature of the works proposed to ba undertaken within the boundaries of the Borough, aro deposited for public inspection in the othce of the Jjocal Authority, being the office of the Borough Council situate in Manukau Read, Parnell, aforesaid. (C) It is intende.l that the authority contained in the said Authorising Order shall be delegated by the Local Authority to Messrs Dillwyn I'arrish and Alfred Parrish, of No. 2. Copthall Buildings, London. (])) A general description of the terms and conditions subject to which the, delegation is to be made, being Messrs Dilhvyn Pavrish and Alfred Parrisb to commence tbe construction of the said works and electrical equipment within eight calendar months from the date of the agreement delegating the said authority, and on failure' to do so, then the powers given or conferred by the snid Authorising Order shall ceaso to be exerciaable by Iho said Dillwyn Parrish and Alfred Parrish, or their assignees lessees or niorlgxeces as provided by Section 28 of the Sacoiid Schedule to " The Tramways Act. 1891." The term of the concession to be conferrod by tbo authority shall be for a term of 21 years from the dato of thij delegation of tho authority contained in the said Authorising Order, intended to be applied for at a rental of £30 per annum for tho first 7 years, and £50 per annum for the rcmainderof theproposed term, payable as from thofirst day of the completion and running of tbo Electric Cars, but nol lator than 18 months from the dato of the delegation. Tho said Authorising Order shall also bo made subject to the following conditions»— Maximum Scale of Tolla and Charges which may bo demanded and taken by the Promoters in respect of the said Tramway. Passengers,—Between the hours of 7,30 a.m. and 7.30 p.m., both inclusive for each passenger for any distance of throo miles of any part thereof, Threepence. Hei iweon tho hours of 7.30 p.m. and 7.:!0 a.m., for leach passenger for any distance of 3 miles or any part, thereof. Sixpence. Children under 3 years of age in chargepf adults to be carried free, Goods and merchandise.—Passengers' ordinary luggage to tho extent of lilbs weight, free; all luggage over that weight may bo charged at t he rates herein fixed for small parcels. Nothing herein contained shall be held to prevent the Promoters from taking an, increased charge over and above the charges hereinbefore limited for the conveyance of goods of any description by agreemnnt with tho owners or persons in charge of such goods, either in respect of conveyance of such goods, except smrll parcels by passenger and other trains, or by reason of any other spociol service performed by the Promoters in rc'ation to tho goods. ]. The said promoters shall, as soon na*the said tramway shall be wholly or partially opened for public traffic, run trains for goodß and passengers daily, but no such train shall run on Sundays but with the permission of the .said Body Corporate, commencing not later than 7.30 a.m. and ending not earlier than 10.30 p.m. 2. A train shall be despatched from the centre, being in' Auckland, along the line every 30 msnutes during each day between 7,50 a.m. and 7.30 p.m. The first of such trains from the said centre along such line not later than 8 o'clock a.m. One train shall be despatched fjom the said centre along such line at at the hours of 9 and 10.30 p.m. 3. Each train shall be run at such speed not being more than 10 miles an hour or less than 3 miles an hour for all or any portion of the said line as the said Body Corporate may from time to time direct. 4. All trains shall pass the corners of streets at a speed not greater than a walking pace, and no train shall be allowed to remain stationary npon the lines except at the Terminus, or at tho authorised stopping places along the line. 5. All trains despatched from a terminus between sunset and sunrise shall be provided with proper lamps affixed in conspicuous positions on the leading carriage and on the last carriage of the train, the lamps on the leading carriage being of a different colour to those on tho last carriage, so as to indicate whether tho train isapproaching or departing; and the said Promoters shall be responsible for the said lamps being kept properly lighted under a penalty not exceeding 40s for each offence. 6. The said Promoters shall also cause to be placed and kept inside every carriage in every train despatched from a terminus between sunset and sunrise a lamp properly lighted, in such a position as sbali be best calculated to throw a light into every part of the inside of the carriage. And the Promoters shall ba responsible for every lamp being kept properly lighted, tinder a penalty hot exceeding 40s for each offence.—Dated at Parnell this third day of February. 1896.--Signed and executed by tho said Corporation of the Mayor, Councillors and Burgesses of tho Borough of Parnell by the said Mayor and two of the said Councillors on behalf of the said Corporation.
