•In lasb week's " Weekly Press and Referee " appears a communication signed by Loughrey and Lane (Mr D. O'Brien's solicitors in the Challenge Stakes lawsuit). The writers state bhab io a letter, which was writben on Mr O'Brien's behalf before any legal proceedings were baken in bhe case, the following proposal was submibted to bbc C.J.C. bo test Mr O'Brien's claim :—Thab a case be sbated and agreed to by both parties and referred to the English Jockey Club, or some other competenb authority in England to be agreed upon, and the decision of bhe referee to be binding on both parties, the party decided againsb bearing all costs of bhe reference. Messrs Loughrey and Lane add :—Wibh regard to' Judge Richmond's commenb as reported, we would like to poinb oub tbab it is incorrect. Judge Richmond did not sib in bhe Appeal Courb on bhe case, as ib is hardly necessary bo abate, as if he possessed such an opinion as be is reporbed to have expressed, he would scarcely havo allowed bhe time of the Courb to be occupied for two days with the argument, and then reserved judgment. Whab Judge Richmond did state was almosb exacbly whab he said in McKinnon v. bhe Wellington Racing Club, although giving judgment againsb bho Club and upsebbine the Stewards' decision, and in obher cases relating to racing and bebting thab have come before bim, viz., " That is was almosb a scandalous thing to bring a disputed racing case into a Courb of Justice for determination," and he prefaced bhis remark by saying he knew nothing aboub this particular case.
