A JOLLY ELECTION DAY.

FIGHTING AT LUCAS CREEK.

Tm: Waitemata election appears to be a fruitful source of trouble. Already a petition causod a second election to be held, now a scrutiny has been demanded for the second election. To-day two men appeared at the Poliae Court to answer the chargo of having been ligbtin;' at Lucas' Creek on the day of election. Their names were Nicholaa Casey and Patrick Hoabh, and they were charged with fighting iv a public place. Mr R. S. Buah, S.M., waß on bhe bench, aleo Mr E. M. Baker, J.P. Mr G. N. Brassoy appeared for tho defendants and abated thab with regard to the case of Patrick Heath, the police after due inquiry were prepared to withdraw the charge. Casey was prepared to plead guilty. He mighb mention in extenuation that the ollenco happened on the day of the contest between hia learned friend Mr Palmer, who was there in Court, and Mr Maeaey. Although both the defendants wero Irishmen, they were ou opposite sides, as Heath was a supporter of Mr Palmer^ and Casey of Mr Massey. Thero had been a considerable amount of Lncaa' Creek whisky aboub and they had been enjoying themselves, but ib ended in a fight. Cusey admitted that he was the aggressor, and asked under the circumstances that he should be leniently treated, as ho had no previous record against him. Sergeant Gamble stated that Sergeant Kelly aaw the two men fighting and had no option bub to lay information against botb. Since then it bad been ascertained that Casey was the aggressor. Ho would ask to withdraw the charge against Heath.

The Bench inflicted a fine of one shilling and costs.

Mr Brasaey paid he wished to make an explanation. Mr Palmer had pointed out to him thab hia remarks aboub Luoaa' Creek whisky mighb laad people to think thab he had supplied the liquor. Ho wished to state that he did not in any way refer to Mr Palmer in that connection. The whisky obtainod that day was as far as he knew paid for by the men themselves.
