YESTERDAY.
(Before Mr Justice Conolly.) Robbery and Assault. — His Honor summed up in favour of the man John Johnson, and after an absence of twenty minutes the jury found him not guilty, and he was discharged, Judge Conolly warning him against drink and bad company. Breaking and Entering. — Arthur Phillips was charged with breaking and entering the house of Joba Burgle, with intent to steal. — Prisoner pleaded guilty. Mr O'Meagher appeared for him. The offence was alleged to havo been committed on the 20th of September, in the Hokianga district. The story of the accused to the prosecutor, a gumdigger, ■was that his dog had got into the house and he had gone afbor it to get it out. The prosecution showed that he had got in through thochimney, and the breaking open of a box in the whare showed intent to steal.—John Burgie, John Whitfield, and J. A. Berwick gave evidence for the Crown. —Mr O'Meagher cross-examined them at length. —Constable Hogg gave evidence for the Crown, and was also called by Mr O'Meagher as to the iad'a character.—The judge summed tip against the prisoner.— The jury were away an hour and then returned a verdict of not guilty.—The prisoner was discharged.
