William Aitken v. L. A. Wood.—Mr C. Buddie moved on behalf of the plaintiff for an order of partition of parb of allotment 71, sec. 1, suburbß of Auckland, in terms of the prayer of the statement of claim, and for instructions as to service of notice of the order upon the legal representatives of Mrs Sarah O'Donnell. a tenant in common of the said land. —Mr Coleman appeared on behalf of the defendant.—There were, Mr Buddie said, three persons interested in tbe land, viz., the plaintiff, the defendant and, an absentee, Mrs Sarah O'Donnell, who had nob been heard of for some fifteen years. An affidavit filed by William Wood stated thab Mrs O'Donnell lefb San Francisco in 1875 for Peru.and that all reasonable efforts had since been made to discover her withoub success. His Honor had previously made an. order appointing Wood trustee, and he was now before the Courb bobh as trustee and beneficiary. His Honor was now asked to divide the land in question into three equal parts, reserving one each for plaintiff and defendant and one for the absentee.—Mr Coleman concurred in.the application, bub asked that notice to the abeentee be diapensedwith.andan order was made as prayed with this amendment.
