Yesterday afternoon, at the Police Court a*ev we went to press, in the prosecution against Alex, Franklin, charged with passing on the railway line, and thereby caueing the recent accident at Ellerslie, the evidence of Dr, Walker, I, Franklin, Thos. Quoi, I\, H T Watt, and J. Paton was taken for the defence. This morning Dr, Gile3, in giving judgment, said that tjie evidence had failed to show that the circumstances did not mitigate in the least the defendant's gross negligence and culpable rashness, He would decide against the defendant and fine him £5 and ±4 13s 4J costs ; ov in default one month's hard labour, He was allowed 48 hours in whio'h to pay the fine,
