(Before Messrs J. Gordon and J. M. Mo Lachlan, Justices.) Drunkenness.—One first.offender was fined 5s and costs, or in default 24. hours hard d Larceny as a Bailee. —Emmanuel Olliver was charged with having, committed larceny as a bailee of one silver watch of the value of £2, the property of William Sayers, at Auckland, on the 31st of May.—Mr C.E. Madden appeared for the defendant, and asked that a remand should be granted. The action' of the police in this matter was quite a surprise to both himsalf and the prisoner. As their Worships were no doubt aware, the prisonerwas already indicted fora number of similar charges, and as be had not been out on bail, this offence must have been committed about the same time as the previous ones. Yet it was not brought on until just a few days before tho opening of the Supreme Court, and without any warning whatever being given the prisoner. — me Bench Baid that the prisoner was entitled to a fair show.— Sergeant-Major Pratt said that the case was taken at tha request of the Crown Prosecutor, as it mu'ht^'ust happen that the other cases would 'be quashed. This one was under another Act. He had no wish to hurry matters, only as the criminal sessions commenced next week he hoped that the case could proceed that day.—The Bench adjourned the case until 2 p.m. in order to afford Mr Madden facilities for consulting with the prisoner.—The Court resumed at 2 o'clock, when evidence was given by William James Sayers as to giving the watch to accused to -be cleaned and riot getting it back again upon calling. — Bernhard Gold water deposed to the accused pawning the watch at Levy's shop, in Victoria-street.—Detective Herbert also gave evidence in the case.— Mr •■ Madden spoke in defence of the accused, but the Bench decided to commit him to take his trial.
