ACTION FOE DAMAGES.

MR E. T. CARTWRIGHT AND THE POULTRY ASSOCIATION.

At the R.M. Court to-day an action for damages for breach of contract, E. T. Cartwright r. the Committee of the Auckland Poultry Association, was called, and adjourned to ailow the evidence of two witnesses to be taken at Christchurch. The defendants in thi3 action are A. H. Grainger, George Hulme, Francis Stephens, Charles Bartley, A. E. Dewes, C. Grey, F. G. Haszard, E. Hayward, W. G. Knight, H. E. Martin, T. S. MorDeth, Charles Phillips, Thomas Phillips," George Towier, W. Waddell, and George Cruickshank. The plaintiff' alleges that on the'lßth July last, in consideration of the invitation and request of the defendants, he entere i certain fowls for; exhibition at the Auckland Poultry, Pigeon, Canary and Dog Association's Show, heldbn the 26th, 27th j and 28th days of July, 1888. The plaintiff also alleges that, at the request; of the defendants, he paid to them towards the competitions for prizes in the classes for w;hich the fowls were entered sums amounting to iil 15s; and that the defendants promised to pay the plaintiff the prizes - and certificates awarded by the judges 'on the 18th day of August following. It is also set out that on the 26th July the judges' awards were made out, and the plaintiff thereby became entitled to 7 prizes valued at £2 5^ ; 10 Icertilicates valued at lOsj and 4 special prizes valued at v£s 7s ; and that the defendants, had refiij'ied to pay over the said awards!", J The plaintiif therefore claims £9 17s, ?iHa3fl' up of £8 2sv damages for breach of agreement, and £1 15s monoy had and received by defendants for the use of plaintiff, which the defendants refuse to pay except upon the plain tiff signing a receipt tendered to him by the defendants, .and which contains statements which the plaintiff refuses. to sign. : The action will probably be heard a fortnight hence.
