BANKRUPTCY PROCEEDINGS.
SUITER AND CO.'S BANKRUPTCY-
The following is the continuation of our report published last evening :—
Tho debtor, under examination by Dr. McArthur, said thab his statement that Messrs Sutton and Co. had supplied him with malb bought ab auction from B. Tonks and rejected by other brewers, was founded on what had been told him and nob from hi 3 own knowledge. Dr. Me Arthur : Did you ask Tonks and Company where bhey gob the malb ? Mr Su'fcer : I did. nob.
A letter from Messrs B. Tonks and Co. was pub in by Dr. McArthur, and read by Mr Lawson, certifying that Messrs Sutton and Co. had never at any time purchased or obtained from them malt which had been returned or rejected by anyone.
Examination continued : I have drawn about £7 103 a week, or about £1 10s weekly over my wages. I can furnish a correct statement of ray drawings in two days' time. The first payment paid from Fuller's estate into the Carlton Club Hotel was £150 on January 24th, 1388.
Dr. McArthur said this £150 might have come from any place, and that it was a pity the debtor had not kept his books straight. Mr Suiter: The books are thoroughly straight. Dr. McArthur: What were the other amounts ?
Mr Suiter : I'll nob show you now ; I'll take time to make it up. Mr Burton (Colonial Bank): Will you move some resolution, Dr. McArfchur, so as to bring this matter before the Supreme Court ? If you will not do so I will, because it will Lave fco go there. In answer to Mr Burton, the debtor stated that he asked Cochrane £5,000 for the Jubilee Hotel, and sold it shortly afterwards to Mr Griffiths for £3,650.
Mr Burton then moved, "That the Officia Assignee be authorised to take action in the Su prenie Court to test the legality of the sale of the Jubilee Hotel to Mr Griffiths." Dr. McArthur seconded the motion, which was agreed to, ¥x S. Hoskef.h (representing
two of the legatees in Fuller's estate) dissenting. Mr Protheroe, examined by Dr. McArthur, stated : I did nob know ac the time that money had been paid from Fuller's estate into the Carlton Club, and the first time I heard of it was in McArthur and Bloomfield's office. I do not know tho date. I know indirectly that the money came from Fuller's estate, because it could come from nowhere else. Mr Burton moved, "That if the sale of the Jubilee Hotel be uphold, the Official Assignee be authorised to take action to test the legality of the mortgage to Suiter and Brown."
Dr. McArthur seconded the resolution, which was carried. Mr S. Hesketh said thab if he could vote ho would vote against the motion. Mr Edgerley moved : " Thab the creditors of Messrs'W. J. Suiterand Co. are of opinion that a public examination of the bankrupts before the Supreme Court is desirable." He said ho looked upon this bankruptcy as ono of the most disgraceful ho had ever seen. Ho thought it was desirable that they should have tho matter before Judge Gillies, and sifted. Dr. McArthur seconded the motion, which was carried, and the meeting then adjourned.
