BANKRUPTCY.
James Whistox, labourer, Auckland, today filed a petition to bo adjudged a bankrupt. A meeting of the creditors in the separate estate of Mr W. J. Suiter, that was to have been held at noon to-day, lapsed for want of a quorum. E. W. Gillingham.—A meeting of the creditors in the estate of E. W. Gillingham was held at 11 o'clock this morning. The following sworn statement made by the debtor was read by the Official Assignee, and was to theeffectthatin October 1885 became out from England, and rented a farm of 100 acres at Tamaki East, at a rental of £120 for the first two years, and £150 afterwards, payable monthly. He only had a capital of £200, and this he invested in stock and implements. At the end of eighteen months he was £90 in arrears with his rent and wished to throw the farm up, selling everything to pay his debts, but his landlord sold him up before he could do this. The sale only amounted to £46, but the debtor was satisfied that if he had been allowed to realise in his own way he would have been able to pay all his debts. He continued:—" I was out of work from March to September, 1887, when I got employment as a butcher at 353 a week, and have kept it ever since. I have a wife and four young children to support ; nevertheless, I have been able to put a3ide a little money towards paying off the old debts without contracting any new ones. In disbursing the savings referred to, I preferred the other creditors to the landlord, because I thought if anybody had to wait he should, having got all my capital. The landlord sued me last week, and this is the sole cause of my failing. My debts amount to £86 13s lOd, and all I have in the nature of assets consists of the household furniture, worth about £5." The creditors present passed the following resolution on the motion of Mr Drover, seconded by Mr Cooper, " That it being clear that no other course was open to Mr Gillingham but to file owing to his landlord having sued him after having previously seized and sold all his effects, the Official Assignee be requested to do all things necessary to expedite the debtor's discharge." A meeting of the creditors in the estate of F. L. Protheor was held at 2.30 this afternoon, when the following resolution was passed :—" That provided the joint creditors relinquish their! claim against or on the furniture of Mr Protheroe the separate creditors allow the debtor to retain his furniture.
George Henry Powley, clothing manufacturer, Auckland, filed a petition this day to be adjudged a bankrupt.
