ASSAULTING A SALVATION ARMY SOLDIER.

At the Police Court, Onehunga, yesterday, before Dr. W. R. Erson and Dr. Leger Erson, J.P.s, Frederick Moßrierty and Dessimus Howe were charged by Constable Haslett with unlawfully assaulting one Jno. Sergeant in a public place (Queen-street, Onehunga) on the night of the 11th inst. They pleaded not guilty, John Sergeant deposed that on leaving the Salvation Army Barracks in company with two brother Salvationists, he was jostled on the footpath by two lads, but whether aecidently or otherwise he could not state. Mcßrierty, who collided with him, said he had been pushed by the other boy. It was not his fault, as he could not help it. Sei'geant Greene deposed to seeing and hearing Mr Sergeant remonstrating with some youths for having jostled him on the footpath. He followed the accused lads, and took them back to Sergeant, who identified them. The accused had no questions to ask either witnesses, but stated to the Bench that tne jostling was quite accidental, as the night was dark, and on finding tha,*, they had collided with someone they begged pardon, as it was unintentior.al. This being the first charge against Mcßrierty, he was dismissed ; with regai'd to Howe, a lad of only 14 years, who had been previously before the Cffurfc, the Bench ordered him to find two sureties in £20 each tQ he of good behaviour for three months.
