I now publish facts ar d n.ako no comments, but leave the public tc judge to.- themselves whether justice has been done or not. DR. BAYNTUN'S CERTIFICATE ON THE 1 7th DECKMBKR, 1885. Bayntun, M.RC.S.B." The following is Dr. Bayntun's evidence copies from the Star, as given in Court on the 12th May, 18861— Dr. FrancißT. Bayntun deposed to attending the last witness on the 3rd of December. Hie nght.foot had boeninjured. Wiiness bandaged the foot, and ordered a lotion, and directed plaintilt to. rest his foot for a few daya. At that time ne could not see any sign of iDjury. Mr Hancan called again a few daysafcerwarde.and witness told him to use the foot. He could not then see any Injuries. Plaintiff was still under his treatment Witness believed that at the present time acute innammation was going on between iho heel and the next bone. This he judged from the symptoms, as stated by the plaintiff. Wit--1)6*8 had also blistered the foot, and applied iodine. The plaintiff also Bhowed his foot -o Dr. Hooper. Without a doubt it had been iDJured Ho had known a man lamed for, life through a eimilar injury. He did not believe that Mr Hannan was simply humbugginß .. His charges for attondanoe would ba about £10. By Mr Cotter : He had watchr-d Mr Hannan whqn be was unaware of it. and had invariably seen him limning. Beyond a alight puttineas witness had to depend upon the symptoms as explained by the plaintiff.
DR. HOOPER'S EVIDENCE. Dr.. Jolm Henry Hooper also deposed to oxatnining tho plaintiff's foot. On the first occasion no inju'y was apparent. Mr Hannan complained of severe pain. Witness advised him to rest the leg. About a month ago, witness noticed a deal of pufllnesa on tho heel. He connidored that tho small b nes at the foot had been injured, and aIBO sub-acute inflammation of tho liganous tissues of the foof. Thero was no appearance at precent of anything very Berious; but a 9 tho caso was etmewhat obscure, it was hard to diagnose or state whit might develop in the future. Was surprised that there was not more to show from such an accident an described by tho plaintiff—By Mr Cotter: Pnfflneas could not be created by simple limping for sham.-By Mr Cooper: His claim against Mr Hannan wouid be about £5 53. AN IMPORTANT WITNESS. Mr Oxenbam, an employe of Mr Bailey, boat builder, when interviewed by Mr Cooper's e'erk, said he would not give any statement, as he was interested in this Company, and would not apprar unless compelled. After the oase was ooncluded, in which I was defeated, and all expenses cast upon me, another of my witnesses, also a resident of the North Shore, sent me the following demand :— "Auckland, 1885 6. " Dear Mr Hannan,—l called this morning to see Mr Cooper about my expenses, as I thought it was time he had done aomethir.g in the matter, seeing that the other witnesses received thelra last woelr. He asked mo what my expenses were, and I. told him what jou Eromia'd me, vie.; J2l Is a day, when c f aid. " Oh! that is monstrous; you aro only entitled to 55," but he slid that.ho would look up the register and send me what was due.. Now, as tho actual stoppage of my wagea ia 13$ Id a day, besides the Inconvenience of aprenriPK. also interviewing, &0., I think that the amount itated by you is only . a fair ramnneration. which I bdlieve I am fairly entttUd to, and which I believe you wilt think with mo is only a fair demand. ' I remain, yours, &c , " E. R. Jones." The above promise I most emphatically deny over having made, . MY REPLY TO MR. JONES'S LETTER. " 81*",—In reply to your demand of £1 Is r-or day, I do feel with Mr Cooper that such demand 18 monstrous, as I never premised any Bum to any of the witnesses, and as yet uonu of thorn has received any money from me. " Mr Cooper, my legal adviser, will settle with yourself and other wUnessee. " Yours, eta, ' J. H. Hannan. " Ta Mr Jones, ot the Northern Boot Faotory.1 CONTRAST. DR. HOOPER'S LETTER. " Hobson-street, May U, 1886 " To Mr J. H. Hannan. — Dear sir, —It has just occurred to me that you might think my account, which you have jnßt pad, inoludts the Court feea. I may state that they are not included ; your solicitor, Mr Tbeo. Cooper, lnylne told me that ha would see to that. However, if you wish to pay me individually, there were three days' attendance at Sapreme Court, at £1 Is per day. But as you have been put to so much expense I will not charge more than S.l 2*. " I am, dear sir, yours truly, " JOHN H. HOOPER." The Registrar assessed expenees on Wednesday, May 26, 1888. To my surprise, the next morning I received tho following :- " To Mr J. H. Hannav, Victoria-street, yourself, and Devonport Co. " Costs in this oase have been taxed and allowed at £S9 69 lOd. Of this amount the Registrar has allowed £10 18s for witnessea" expenses, an affidavit having been filed that this amount had been paid. Mr Coleman says he will give no time to you, nor make any concession, his inEt'Uctions being to enforce the matter to the utmost extremity. " Yours, Sec, " Dkvore & Cooper." LETTER FROM THE COMPANY'S LAWYER TO MINE. " May 27,1886. "Messrs Devore and Cooper, Solicitors.— D.B.F. Company v. Hannan. "We have to request payment from jour client, Mr Hannan, of the defendant's t»xed coat*, amounting to £99 6a lOd, Unless the amount be paid to ua to day. our instructions are to issue execution without further notice. " Wm, Couiman." Leaving you to judge for yourselves from the foregoing letter and evidence, I conclude by stating that, besides the serious loss to my business, I am likely to be a cripple for life.
